Distance Sales Agreement

Article 1 — Parties

Buyer: the person who places an order on u1coffee.com, whose name, contact and delivery details are given during the order.
Article 2 — Subject
This agreement sets out the rights and obligations of the parties, under Consumer Protection Law No. 6502 and the Distance Contracts Regulation, for the sale and delivery of the products the Buyer orders electronically on u1coffee.com, whose details and price are shown in the order summary.
Article 3 — Product and payment details
The type, quantity and VAT-inclusive price of the products, the shipping fee, the total and the payment method are those shown at checkout and in the order confirmation emailed to the Buyer; they form an integral part of this agreement. The shipping fee is paid by the Buyer.
Article 4 — Delivery
Products are delivered by Aras Kargo to the address given by the Buyer. Orders placed on weekdays before 14:00 ship the same day. Delivery is made within 30 days of the order date. If an ordered product cannot be supplied, the Seller informs the Buyer and refunds the amount paid within 14 days.
Article 5 — Right of withdrawal
The Buyer may withdraw within 14 days of receiving the product without giving a reason and without penalty, by notice to contact@u1coffee.com. The Buyer returns the product within 10 days of the notice using the Aras Kargo return code provided by the Seller; in that case the return shipping is paid by the Seller. Within 14 days of receiving the notice, the Seller refunds the full amount collected, including delivery costs, to the Buyer's payment method, free of charge.
Article 6 — Exceptions
Under Article 15 of the Distance Contracts Regulation, the right of withdrawal does not apply to products whose protective packaging, tape, seal or package has been opened after delivery and which are unsuitable for return for health and hygiene reasons. Opened coffee capsule and whole bean packs fall into this category.
Article 7 — Defective products
Defective, damaged or wrongly sent products may be returned at the Seller's expense. The Buyer's rights under Article 11 of Law No. 6502 are reserved.
Article 8 — Personal data
The Buyer's personal data is processed only for the purposes set out in the Privacy Notice (KVKK).
Article 9 — Disputes
Disputes arising from this agreement go to the Consumer Arbitration Committees within the monetary limits announced by the Ministry of Trade, and to the Consumer Courts above those limits.
Article 10 — Effect
Before completing the order, the Buyer confirms having read the Pre-Information Form and this agreement and approves them electronically. The agreement takes effect when the order is completed; a copy is sent to the Buyer with the order confirmation email and kept by the Seller.

Alıcı: u1coffee.com üzerinden sipariş veren ve adı, iletişim ve teslimat bilgileri sipariş sırasında beyan edilen kişi.
Madde 2 — Konu
Bu sözleşmenin konusu, Alıcı'nın u1coffee.com üzerinden elektronik ortamda sipariş verdiği ve nitelikleri ile satış fiyatı sipariş özetinde belirtilen ürünlerin satışı ve teslimine ilişkin olarak, 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve Mesafeli Sözleşmeler Yönetmeliği hükümleri uyarınca tarafların hak ve yükümlülüklerinin belirlenmesidir.
Madde 3 — Ürün ve ödeme bilgileri
Ürünlerin türü, adedi, KDV dahil satış fiyatı, kargo ücreti, toplam tutar ve ödeme şekli, sipariş anında ödeme adımında gösterilen ve Alıcı'ya e-posta ile gönderilen sipariş onayında yer alan bilgilerdir; bu bilgiler sözleşmenin ayrılmaz parçasıdır. Kargo ücreti Alıcı'ya aittir.
Madde 4 — Teslimat
Ürünler, Alıcı'nın siparişte belirttiği adrese Aras Kargo ile teslim edilir. Hafta içi 14:00'e kadar verilen siparişler aynı gün kargoya verilir. Teslimat, sipariş tarihinden itibaren 30 günü aşmamak kaydıyla yapılır. Satıcı, sipariş konusu ürünün temin edilemediği durumlarda bunu Alıcı'ya bildirir ve tahsil edilen tutarı 14 gün içinde iade eder.
Madde 5 — Cayma hakkı
Alıcı, ürünü teslim aldığı tarihten itibaren 14 gün içinde herhangi bir gerekçe göstermeden ve cezai şart ödemeden sözleşmeden cayabilir. Cayma bildirimi contact@u1coffee.com adresine yapılır. Alıcı, bildirimden itibaren 10 gün içinde ürünü, Satıcı'nın ilettiği Aras Kargo iade koduyla iade eder; bu durumda iade kargo ücreti Satıcı'ya aittir. Satıcı, cayma bildiriminin kendisine ulaştığı tarihten itibaren 14 gün içinde, teslimat masrafları dahil tahsil ettiği tüm bedeli, Alıcı'nın ödemede kullandığı ödeme aracına uygun şekilde ve masrafsız olarak iade eder.
Madde 6 — Cayma hakkının istisnaları
Mesafeli Sözleşmeler Yönetmeliği'nin 15. maddesi uyarınca; teslimden sonra ambalaj, bant, mühür veya paket gibi koruyucu unsurları açılmış olup sağlık ve hijyen açısından iadesi uygun olmayan ürünlerde cayma hakkı kullanılamaz. Ambalajı açılmış kahve kapsülü ve çekirdek kahve paketleri bu kapsamdadır.
Madde 7 — Ayıplı ürün
Ayıplı, hasarlı veya hatalı gönderilen ürünler Satıcı ödemeli olarak iade edilebilir. Alıcı'nın 6502 sayılı Kanun'un 11. maddesindeki seçimlik hakları saklıdır.
Madde 8 — Kişisel veriler
Alıcı'nın kişisel verileri, KVKK Aydınlatma Metni'nde belirtilen amaçlarla sınırlı olarak işlenir.
Madde 9 — Uyuşmazlıklar
Bu sözleşmeden doğan uyuşmazlıklarda, Ticaret Bakanlığı'nca ilan edilen parasal sınırlar dahilinde Tüketici Hakem Heyetleri, bu sınırları aşan durumlarda Tüketici Mahkemeleri yetkilidir.
Madde 10 — Yürürlük
Alıcı, siparişini tamamlamadan önce Ön Bilgilendirme Formu'nu ve bu sözleşmeyi okuduğunu ve elektronik ortamda onayladığını kabul eder. Sözleşme, siparişin tamamlanmasıyla yürürlüğe girer; bir örneği sipariş onay e-postası ile birlikte Alıcı'ya iletilir ve Satıcı tarafından saklanır.
